Terms of Use

Introduction
These Terms of Use govern your use of Pack (“Pack”, “we”, “us”, “our”), a marketplace platform connecting parents and caregivers with verified children's activity providers. By accessing or using Pack, you agree to these terms. If you do not agree, do not use the platform.
Pack operates as a marketplace and technology platform. We are not an activity provider and do not directly deliver children's activities. Providers are independent businesses responsible for the services they offer.
1. Who can use Pack
Pack is available to:
- Parents and caregivers aged 18 or older who are booking activities on behalf of children in their care.
- Activity providers who have been verified by Pack and accepted onto the platform.
Pack is not directed at children. Children under 13 may not create accounts. Children aged 13–17 may not create accounts without verified parental consent. All bookings for children must be made by a parent or legal guardian.
2. Provider verification
Pack verifies providers before they are listed on the platform. Verification includes review of business credentials, liability insurance, and background checks for staff working directly with children. Verification is designed to establish a reasonable baseline of trust and does not constitute an endorsement of any provider's services, instructional quality, or suitability for any particular child.
Pack reserves the right to suspend or remove any provider at any time if verification standards are not maintained or if concerns are raised about the safety or welfare of children in their care.
3. Bookings and payments
All bookings are made through Pack's platform and processed by Stripe, our third-party payments partner. By making a booking, you authorise Pack to charge your payment method for the booking amount plus Pack's customer service fee of 4% of the booking value.
Providers receive payment net of Pack's platform fee of 8% of the booking value. This fee covers payment processing, platform access, verification infrastructure, and parent-facing discovery tools.
All prices displayed on Pack are in US dollars and include applicable taxes unless stated otherwise.
4. Cancellations and refunds
Each activity on Pack has a cancellation policy set by the provider. This policy is displayed on the activity listing and confirmed at checkout. By completing a booking, you acknowledge that you have read and accepted the applicable cancellation policy.
Regardless of the provider's cancellation policy, parents have a 24-hour cooling-off period following any booking. If you cancel within 24 hours of booking, you will receive a full refund, provided the session is not scheduled to begin within that 24-hour window.
If a provider cancels a session, you will always receive a full refund of the booking amount. Pack's customer fee is also refunded in the event of a provider cancellation.
Refunds are processed by Stripe and typically appear within 5–7 business days, depending on your bank.
Pack's fee is not charged on refunded bookings.
5. Provider terms
By joining Pack as a provider, you agree to:
- Maintain valid business registration, liability insurance, and any required permits for the activities you offer.
- Ensure all staff working directly with children have completed required background checks.
- Keep your Pack profile accurate and up to date at all times.
- Honor the cancellation and refund policies you have configured on Pack. You may not apply more restrictive terms than those disclosed to parents at the time of booking.
- Always offer a full refund when you cancel a session. Provider cancellations may not result in partial or no-refund outcomes for parents.
- Treat child profile data shared by Pack as confidential. You may use it only to deliver the booked activity. You may not retain it beyond what is necessary, use it for marketing, or share it with third parties.
- Comply with all applicable laws, including COPPA, CCPA, and any California-specific regulations relating to children's activities.
Pack reserves the right to suspend or terminate provider accounts for breach of these terms without prior notice where child safety is a concern.
6. Child data and COPPA compliance
Pack is committed to protecting the privacy of children. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information directly from children under 13.
Child profile information — including name, date of birth, medical notes, allergies, and emergency contact details — is entered by a parent or guardian and used solely to facilitate bookings and activity matching. We do not use child data for advertising, profiling, or any purpose beyond service delivery.
Parents may request deletion of their child's profile and all associated data at any time by contacting support@packforkids.com. We will process deletion requests within 30 days.

7. Parent responsibilities
By booking through Pack, you confirm that:
- You are the parent or legal guardian of the child being booked, or have explicit permission from the parent or guardian to make the booking.
- The medical and health information you provide about your child is accurate to the best of your knowledge.
- You understand that Pack shares relevant child profile information with providers to facilitate the activity, and you consent to this sharing.
- You will ensure your child arrives prepared for the activity and follow the provider's rules and instructions.
Pack is not responsible for injury, loss, or damage arising from a child's participation in an activity. Liability rests with the provider. Pack strongly recommends reviewing a provider's insurance coverage and policies before booking.
8. Medical disclosure
Parents are responsible for disclosing relevant medical information, allergies, and health conditions when creating a child profile. Pack passes this information to providers as a courtesy to assist with activity delivery. Pack does not verify, assess, or act on medical information and is not responsible for any consequences arising from undisclosed, inaccurate, or incomplete medical information.
Providers who receive medical information through Pack are responsible for determining whether they can safely accommodate the child. Pack makes no guarantee that any provider can accommodate specific medical needs.
9. Intellectual property
All content on Pack — including logos, copy, design, and software — is owned by Pack or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.
Provider profile content (descriptions, photos, logos) remains the intellectual property of the provider. By uploading content to Pack, providers grant Pack a non-exclusive licence to display that content on the platform.
10. Prohibited uses and automated access
You may not:
- Use automated tools, bots, scrapers, crawlers, or scripts to extract, copy, or harvest data from Pack, including provider listings, pricing, availability, session data, or any other content
- Use data extracted from Pack for commercial purposes without our written permission
- Circumvent rate limits, access controls, or technical measures designed to protect the platform
- Systematically download or cache Pack content beyond what is necessary for normal use
Automated access for search engine and AI discovery indexing is permitted where expressly allowed by our robots.txt file. All other automated access requires written permission from Pack.
Pack reserves the right to block access to any user or system that violates this section and to pursue legal remedies where applicable.
Anonymised data and advertising:
Pack may use anonymised, aggregated data derived from platform usage for commercial purposes, including market research and — in future — interest-based advertising directed at broad audience categories. No personally identifiable information, and no data relating to children, will ever be used for advertising purposes. Pack will notify users and update its Privacy Policy before introducing any advertising features.
11. Limitation of liability
To the maximum extent permitted by applicable law, Pack shall not be liable for: any injury, loss, or damage arising from participation in an activity; any loss arising from provider cancellation or non-performance; any indirect, incidental, or consequential damages arising from use of the platform.
Pack's total liability to any user for any claim arising from use of the platform shall not exceed the total fees paid by that user to Pack in the 12 months preceding the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12. Governing law
These terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Orange County, California.
13. Changes to these terms
Pack may update these terms from time to time. We will notify registered users by email of material changes. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.
